0:00 Hi, crime junkies. I'm your host, Ashley
0:01 Flowers.
0:02 >> And I'm Brett.
0:02 >> And the story I have for you today about
0:04 the 2009 murder of a Washington DC salsa
0:08 queen is one that haunts me. At first,
0:11 investigators thought this might be an
0:13 easy case to close. They have
0:15 surveillance footage, a clear recounting
0:17 of the victim's final steps. But there
0:19 is one huge problem. It was Halloween.
0:23 The clubs were packed and the streets
0:25 were full of people in masks and
0:27 costumes. So, even on camera, police
0:30 can't always tell who they're looking
0:32 at. Was that a coincidence? Or was it
0:36 part of a careful plan to hide in plain
0:39 sight? It seems like this killer knew
0:43 what he was doing. He took things from
0:45 the crime scene that might have led back
0:47 to him, but in doing so, he actually
0:52 might have left the biggest clue. This
0:55 is something that has never been
0:56 reported before. and me and our
0:58 reporting team went deep on this one and
1:01 what this clue might mean. And we think
1:03 we could be just one tip away from
1:04 solving this one. So, crime junkies,
1:07 listen close and make sure you share
1:10 this episode with a friend, especially
1:12 any friends that you have in the DC
1:14 area. This is the story of Noria.
1:21 Our
1:24 story begins first thing Monday morning,
1:26 November 2nd, 2009. Carlos Amaya is
1:30 getting to work to begin a week that is
1:32 already off to a rough start. So Carlos
1:35 is the chef and co-owner of a popular
1:37 Italian restaurant in Washington DC,
1:40 which he runs with his sister. And even
1:42 though he just hosted this big private
1:43 party the night before, he is at the
1:45 restaurant bright and early on just a
1:47 couple of hours of sleep to fire up the
1:49 wood burning oven and get started on a
1:51 massive catering order for something
1:53 like 170 people. But when he calls the
1:56 client to let them know that he's going
1:57 to be there with the order around 10:00
1:59 a.m., the client is like, "No, no, no.
2:01 Your sister never confirmed the order."
2:03 So, we tried to call her and tell her
2:05 that it was cancelled.
2:06 >> Oh, I'd be so pissed at my sister.
2:09 Carlos was his 38-year-old sister, Noria
2:12 Amaya, is the other half to the
2:14 business. He's the chef. She works like
2:16 front of house on the customer side of
2:18 things, and it's like a good arrangement
2:19 because she's the people person of the
2:22 two siblings.
2:23 >> So, normally it works out, but something
2:26 has been up with her the last couple of
2:28 days.
2:29 >> The day before, Nory didn't show up to
2:31 help with the private party like she was
2:33 supposed to. Carlos kind of blew that
2:35 one off because he knows that she had
2:37 been going through a breakup and he was
2:39 trying to like cut her a little bit of
2:40 slack, but now they're like losing
2:42 business and he is over it.
2:45 >> He wants to call her and like read her
2:47 the riot act. The problem is he can't
2:50 because her phone is with him. You see,
2:53 two nights ago, what would have been
2:55 Saturday, that was Halloween, and Nory
2:58 had apparently left her phone in a cab
2:59 that she took home that night, or
3:01 technically it would have been like
3:03 early Sunday morning. The cabbie found
3:05 the phone and at some point called
3:06 Nory's mom, who sent Carlos to go meet
3:08 the cabbie and pick it up.
3:10 >> Okay, so why is Carlos still holding on
3:11 to it, though?
3:12 >> Well, cuz he thought he was going to be
3:13 seeing her at work that same day. He was
3:15 just going to like give it to her then,
3:16 but she didn't show. And remember, it's
3:18 like 2009. Like we actually at that time
3:20 all knew how to live without our phones
3:22 for a day back then, especially Nory
3:25 because apparently she was prone to
3:26 losing her phone maybe more than most.
3:29 So unable to call her, Carlos decides to
3:32 go by Nory's apartment because he's got
3:35 the time now that he doesn't have to
3:36 like do this, you know, big 170 person
3:38 catering order. So when he gets to her
3:41 complex like 10 minutes away, he signs
3:43 in at the front desk before going to her
3:45 unit on the 11th floor. He knocks. He
3:48 checks the door, but it's locked. So, he
3:50 crouches down and even looks through the
3:52 mail slot. And he can see inside, but
3:55 the lights are off. So, the apartment is
3:56 completely dark. And so, Carlos is
3:58 thinking like, "Okay, you know what?
4:00 Nory is clearly going through it with
4:02 this breakup. She's probably still
4:04 asleep." Or maybe she just doesn't want
4:06 to talk to anyone right now.
4:08 >> So, he decides to give her a little bit
4:11 more space. If she's not at the
4:13 restaurant by the dinner shift, then
4:15 he'll take more drastic measures to like
4:17 shake her out of it. And guess what?
4:20 >> She doesn't show up.
4:20 >> By closing time on Monday, Carlos's
4:23 frustration is turning into fear. He has
4:26 made some calls. Nobody in their family,
4:29 including their mom, who normally talks
4:30 to Nory daily, has heard from her. So
4:33 that night, Carlos and his younger
4:36 sister Liz, they go to Norie's building
4:37 together. And they're not just knocking
4:39 at this point. They told us this time
4:41 they asked the security guard to unlock
4:43 Norie's door and it's the guard who
4:45 leads the way into her living room.
4:48 Everything is still dark except for a
4:50 bathroom light that's on. So Liz flips
4:53 on the light switch. They see Nory's
4:55 Halloween costume laying on the couch,
4:57 this like black dress and a feathered
4:59 Venetian style mask, but no Nory. And
5:03 nothing seems to be out of place. So
5:05 Carlos calls out to her like to give her
5:08 the chance to come out or get decent
5:09 before he just like opens her bedroom
5:11 door. Now the room is dark when he
5:14 finally goes in, but he can tell that
5:16 Nory is in her bed partially covered by
5:19 a comforter. And then the rest happens
5:22 quickly. He turns on the light. He sees
5:24 Norie's hair and one of her hands
5:26 peeking out from under the covers. And
5:28 when he gets closer, he notices marks
5:31 around her neck. So Carlos pulls the
5:33 comforter back and his sister is blue.
5:36 She's only in her black underwear so he
5:38 can see all of the bruises all over her
5:41 body. But there's something in him like
5:44 he cannot stop calling out her name like
5:46 begging her to just like get up even
5:48 though like looking at her you and I
5:50 would know that's not computing for him.
5:51 >> He's in shock. He's just like desperate
5:53 to get some kind of reaction out of her.
5:55 So he even like hits her trying to prove
5:57 to himself that what he's seeing isn't
5:58 real because his mind cannot accept that
6:01 she's gone. And that's when Liz walks
6:03 into the room. And she reaches out to
6:05 touch Nory, but her skin is so cold that
6:07 Liz literally jumps back. She and Carlos
6:11 cling to each other and just like drop
6:13 to the floor while the security guard
6:15 calls 911. By 9:11 p.m., the apartment
6:20 is full of DC Metro Police officers. The
6:23 detective who is assigned to the case is
6:25 Tony Patterson. Now, lucky for us,
6:28 Detective Patterson is retired now, so
6:30 he was able to talk to us for this
6:32 episode. I actually don't know if we
6:34 could have done it without him because
6:35 DC Metro Police Department denied our
6:37 foyer. And while the new MPD detective
6:40 assigned to the case did talk to us,
6:41 like he didn't go into much depth with
6:43 us. Still, he gave us some information,
6:46 verified some details, so like grateful.
6:49 But much of what we've come to learn
6:50 about this case will be from Detective
6:52 Patterson's memory. But going back to
6:54 that night inside Nory's apartment, by
6:57 that point, Detective Patterson's been
6:59 with MPD for decades. A lot of that time
7:02 was spent in homicide, so he knows what
7:05 he's looking for when he gets onto a
7:07 homicide scene. And here, I mean, we've
7:09 got locked door. No signs of forced
7:11 entry. The apartment isn't ransacked. In
7:14 fact, nothing valuable seems to be
7:16 missing. Nory's purse is still on the
7:18 couch. So, this wasn't a robbery gone
7:21 wrong. This looks like somebody came
7:24 here for Nori with the goal of either
7:27 sexually assaulting her, killing her, or
7:30 both. It was a 1/8 in ligature of some
7:34 kind that ultimately was used to
7:36 strangle and kill her. But the autopsy
7:38 shows that she fought back. There were
7:41 injuries around her mouth and her chin,
7:43 including a laceration inside her lower
7:46 lip. There's a hemorrhage under the back
7:49 of her scalp, bruising across her upper
7:52 right chest, and both breasts, and lots
7:55 of bruises and abrasions on her arms,
7:58 right hand, and right leg. Detective
8:01 Patterson remembers that bruising on her
8:03 arms. It made him think that someone may
8:05 have like pinned her down on the bed
8:07 while she fought back. And there's also
8:10 lacerations and bruising to Norri's
8:12 genital area. And one of the few details
8:15 we did get from the new investigator is
8:17 that they believe Nori was sexually
8:20 assaulted. But whoever assaulted and
8:22 strangled her was calculated and at
8:25 least had a basic understanding of
8:27 forensics because there was no semen
8:30 found during the autopsy and no nail
8:33 clippings that produced anything useful
8:35 because the fingernails that Nory always
8:38 kept long had been cut all the way down.
8:44 And Brit, the killer had to have taken
8:46 the fingernails with them because there
8:50 weren't any in her apartment. I
8:52 >> mean, I have so many questions, but
8:54 like, did the killer bring their own
8:56 clippers? Did they have to use like what
8:58 was there? Hers.
8:59 >> The current detective told us that they
9:02 don't know what her nails were cut with.
9:04 They also don't know what she was
9:06 strangled with. Like, it could have been
9:08 a cord of some kind. I know they tested
9:10 a USB cord in her room, but that didn't
9:12 have any of her DNA on it.
9:14 >> So, whatever that was, he may have
9:17 brought it or found it. But either way,
9:19 probably took that with him, too.
9:21 >> And with all this like
9:25 caution, this person either watches like
9:27 a lot of CSI or they've done this
9:30 before.
9:30 >> I mean, my own opinion, I don't think
9:32 they were some kind of like brilliant
9:34 mastermind. Like I think they knew about
9:36 as much as the general public like
9:37 you're saying from like CSI or something
9:39 like they're going to know that police
9:40 get DNA from semen from nail clippings
9:42 like the end.
9:43 >> Otherwise I think this killer would have
9:45 taken more precautions because the
9:48 killer didn't get rid of all of the
9:50 physical evidence. During the autopsy
9:53 unidentified male DNA was collected from
9:57 two areas of Norie's body. And I know
9:59 they got touch DNA from either her chest
10:02 or her breast area. actual touch DNA or
10:05 could it have come from like saliva?
10:07 >> So, the autopsy report doesn't show any
10:10 of the results from the testing. It just
10:12 shows me what areas they swabbed.
10:15 >> They should be able to tell if saliva
10:17 was present or not. I've seen that in
10:19 other cases. No one from MPD could or
10:22 would provide us the details. They just
10:24 said that it was touch DNA. But Carlos
10:27 is pretty dialed into the investigation,
10:29 Nory's brother. and he said that he
10:32 remembers being told that it was like
10:34 true touch DNA like from skin-to-skin
10:37 like contact kind of thing.
10:38 >> Now, one would assume that would be like
10:41 a hand.
10:42 >> But if it was, that's wild to me because
10:45 the police didn't find any fingerprints
10:48 on her body or apartment that they
10:49 believe were from the killer. But you
10:52 know, who needs prints when you have
10:54 their DNA, right?
10:56 >> Right. Well, it's only good if we can
10:59 find someone to compare it to. Because
11:01 even though this sample was good enough
11:04 to be put into Cotus, there were no
11:06 matches in the system. So, who could
11:11 have been in Nor's apartment and when?
11:14 The autopsy doesn't include a time of
11:17 death window. So, that's one of the
11:18 first mysteries that Detective Patterson
11:20 has to solve. Like before you can ever
11:22 ask somebody for an alibi, you need to
11:24 know like what your critical window of
11:26 time is in the investigation.
11:28 >> Well, lucky for him, Nory's apartment
11:30 building has decent security. It is one
11:32 of the biggest apartment complexes in
11:34 DC. It is 12 floors and more than,00
11:37 units.
11:38 >> That's basically a small city.
11:39 >> Yeah. So, if you live there, you need a
11:41 key card to swipe into the main
11:43 entrances. The front desk is staffed
11:45 around the clock and visitors are
11:47 supposed to sign in. There were also at
11:49 least six cameras in the lobby and more
11:52 cameras around the building and garage.
11:54 So, of course, Detective Patterson
11:57 thinks that all of that surveillance is
11:59 going to just hand him Nory's killer on
12:01 a silver platter.
12:03 >> He goes right to the night of Halloween
12:05 when he's looking at this footage. That
12:06 is the last time that anyone says they
12:08 saw or spoke to Nory. That's the night
12:11 that she left her phone in the cab. So,
12:13 he scrubs through Saturday into the
12:15 early morning hours of Sunday, and he
12:18 spots her coming into the building alone
12:21 around 2:30 a.m. They know it's her
12:24 because she's got on a black dress, and
12:26 she's holding the mask that they found
12:28 on her couch. But guess what? It's
12:32 Halloween and everyone is wearing
12:35 costumes.
12:35 >> Everyone all weekend, people are coming
12:39 and going in masks and wigs and
12:42 costumes. So, even if someone came
12:44 through the front and was captured, we
12:46 might not even have their face. And
12:48 that's if they came through the front.
12:52 Carlos told us at the time there were
12:54 other ways to get into the building,
12:56 like near the parking areas that weren't
12:58 covered by cameras at all. And Nory's
13:00 floor didn't have any cameras either.
13:03 So, is the killer on film? I think the
13:07 answer is yes and no. No, they're
13:11 probably not showing their face in the
13:13 building security footage, but yes, I
13:17 think their image could have been
13:19 captured on film, actually by Nory
13:23 herself. Because as the police start
13:26 working backwards, tracing Norie's
13:28 movements before she got to her
13:31 apartment building, they realized that
13:33 she had something else with her that
13:35 night. A small red digital camera. But
13:40 they never found a small red digital
13:42 camera anywhere in her apartment, which
13:45 means the killer may have taken
13:48 something from Nory after all.
13:55 Nor's family tells Detective Patterson
13:58 that she had a small red digital camera
14:00 that she took everywhere.
14:03 >> I mean, it's 2009. We all did. My little
14:06 Sony Cybershot went everywhere with me
14:09 and it was blue.
14:10 >> And that is actually what her family
14:11 thinks they remember her having, a red
14:14 Sony Cybershot.
14:15 >> Detective Patterson told us that he
14:17 knows she had it out with her that
14:19 night. He found video proof of it
14:21 because he traced her movements that
14:23 night and he found out that she had
14:25 spent Halloween at a club like salsa
14:27 dancing with friends. And salsa dancing
14:30 was like her big thing. It became part
14:32 of her recovery after she went through
14:33 some health issues when she was younger.
14:35 And she got so good at it that she even
14:37 competed locally. She knows basically
14:39 every salsa club in DC. And people even
14:42 called her the salsa queen. Now, this
14:44 club that she was at, police say there
14:47 were no standout incidents that happened
14:49 while she's out dancing. No big fights
14:51 or anything that gets like caught on
14:52 surveillance cameras that they look at.
14:55 But there was drama. So, remember how I
14:58 said that Nori was going through a
15:00 breakup? Yeah. So, the club was owned by
15:03 the guy she was breaking up with.
15:06 >> Breaking is active. So, she was ending
15:09 things.
15:09 >> Well, yes, kind of more complicated than
15:12 that, which I'll get into, but she was
15:15 planning to end it that night. So, let
15:19 me give you a little bit of backstory
15:21 and then I'm going to jump back into the
15:22 timeline.
15:23 Detective Patterson learns from Nory's
15:25 family and friends that for a few months
15:28 before she was murdered, she was
15:29 involved with the club's owner, this guy
15:31 named Gustavo. Gustavo didn't respond to
15:34 our outreach. So, his perspective comes
15:36 from a 2010 interview that he gave to
15:38 the Washington Post about Nory's murder.
15:41 But he said that he and Nory had a lot
15:43 in common. I mean, both were immigrants
15:44 from Latin America who had made like the
15:47 DC area home. Nor's family came to the
15:50 US from El Salvador when she was
15:51 younger. and Gustavo came to DC from
15:53 Argentina and both had built their lives
15:56 around the restaurant business. Nori
15:58 took over the Italian restaurant with
16:00 Carlos and Gustavo opened his Latin
16:02 American club. So they both knew what it
16:05 was like to build something of their own
16:07 here. The same long hours, the same
16:10 stressors, same business problems, and
16:13 the same passion. And he said they were
16:15 exactly alike. But there was a major
16:19 part of Gustavo's life that Nori didn't
16:22 know about when they first started
16:24 seeing each other. He was married. And
16:27 Nori only found out after she was
16:30 already in deep. People close to Nory
16:34 told us that after Nory confronted
16:36 Gustavo, he told her that the marriage
16:38 was basically over, but getting divorced
16:40 could cost him everything. The
16:42 restaurant, his money, all of it. So he
16:44 apparently told her that like you know
16:46 him and his wife being together that was
16:47 just like a financial arrangement. Now
16:50 whether that was true or not, Nori kept
16:53 seeing Gustavo. But Carlos says that
16:55 over time it was clear to her that
16:57 Gustavo didn't want to build a future
16:59 with her. At least not the kind that she
17:01 wanted. I mean Nori wanted to get
17:03 married and have kids. And she was tired
17:05 of feeling like she was stuck in the
17:07 middle of someone else's marriage. Now,
17:10 Gustavo said in that 2010 interview that
17:12 he felt like things were moving fast as
17:15 the relationship got more serious, like
17:17 a little too fast. And you know who else
17:20 might not have liked how fast things
17:21 were moving? Gustavo's wife.
17:24 >> Yeah.
17:24 >> Carlos said that about 2 weeks before
17:27 Norie's murder, the main phone rang at
17:30 their restaurant. Carlos picked it up
17:33 and the woman on the other end asked to
17:34 speak with Nori and said that she was
17:36 Gustavo's wife. So Carlos says he takes
17:39 down her name and phone number on the
17:41 restaurant's like reservation clipboard
17:43 and he gave that message to his sister.
17:45 He doesn't know if Nory called this
17:47 woman back or what happened, but clearly
17:50 like Cat was out of the bag.
17:52 >> And if the two women were comparing
17:54 notes, Nory might have realized that she
17:57 was getting worked. That's the headspace
18:00 that she seemed to be in by Halloween.
18:03 She was at a breaking point. And so,
18:06 normally Norie loved Halloween. Like,
18:08 every year she would make these
18:09 elaborate costumes and celebrate by
18:11 going dancing. But that year, Carlos
18:13 says that she was so upset about Gustavo
18:15 that she didn't even bother to make a
18:17 costume. He actually made the mask for
18:19 her that she wore. I guess he found this
18:21 like old Venetian style mask in their
18:23 upstairs office. He like took it apart,
18:25 added some bright feathers, and that's
18:27 what Nory wore with like a black dress.
18:30 >> So, back to Halloween night. That night,
18:34 it was Nory's turn to get off early and
18:37 Carlos's to close the restaurant. And
18:40 around 9:30 p.m., they sat at the bar to
18:42 have dinner and share a bottle of their
18:44 favorite wine together. And Carlos says
18:47 that over dinner, Nory started crying
18:50 about Gustavo. She felt like she was
18:52 finally done with him, like ready to
18:55 break up for good. Carlos told her that
18:58 she deserved better. And then around
19:00 10:30 p.m., Nori headed out for the
19:03 night. Her first stop was Gustavo's
19:06 Club, the Roomba Cafe. Like I said,
19:09 there was video footage from her time
19:10 there that Detective Patterson reviews.
19:12 And everything's normal. People were
19:14 dancing, drinking, moving through the
19:16 room in costumes and masks. And at one
19:19 point, he sees Nory sitting at a table
19:22 taking pictures with the small red
19:24 camera that would later go missing. But
19:26 here is where the drama starts. Though
19:29 none of it is really like caught on
19:30 film, Detective Patterson pieces it
19:32 together through talking with people who
19:34 were there that night, like Gustavo and
19:36 Nory's two friends, who I'm going to
19:38 call Amanda and David for privacy
19:40 reasons. Detective Patterson learns that
19:42 Nory spent at least part of the night
19:44 around Gustavo. At some point, she asked
19:48 him to sit with her, but Gustavo said
19:49 no, he was working. And Gustavo
19:51 remembered later that Nori seemed sad
19:54 behind her mask.
19:55 >> I wonder why.
19:56 >> Right. And Detective Patterson remembers
19:58 even texts that Nory sent to a friend
20:00 around this time of the night. She said
20:02 that she was upset because Gustavo
20:03 wasn't paying any attention to her. So
20:05 eventually she left without saying
20:07 goodbye to anyone
20:08 >> and she left on her own.
20:10 >> Yeah. So her one friend David said that
20:12 he got pretty drunk and so someone took
20:14 him home from the club. And her other
20:15 friend who I'm calling Amanda said that
20:16 she stayed and partied into the night
20:18 with Gustavo and his group near Roomba
20:20 after Nory left, which at first like I
20:22 thought was kind of weird. like why are
20:23 you staying with your friend's ex that
20:25 she's like having problems with? But
20:27 Amanda actually worked at Roomba Cafe
20:29 before. So she was actually friends
20:30 >> kind of like her group first.
20:32 >> She was friends with both of them,
20:33 right?
20:33 >> But wait, like did Nory actually break
20:36 up with Gustava or No.
20:38 >> Well, according No. No. So according to
20:39 Gustava, she did not. Now Nori doesn't
20:43 go right home from here when she leaves
20:45 Roomba Cafe. She never let anything,
20:48 even a bad night, get in the way of her
20:50 dancing. So, Detective Patterson said
20:53 that she went to a lounge and then to a
20:55 club downtown to meet up with her dance
20:57 partner. But tonight, something was
21:00 different. She got to the downtown club
21:02 called Bravo Bravo around 1:45 a.m. And
21:06 her dance partner told Detective
21:08 Patterson that she wanted to leave
21:10 almost immediately. It looked to him
21:11 like she was crying under her mask. So
21:14 within 15 minutes of being there, he
21:16 walked her outside, helped her into a
21:18 cab back to her apartment, and watched
21:20 her leave. That is the cab that took her
21:23 home. We know she gets there by 2:30.
21:26 And Carlos told us that he remembers
21:28 police's best guess being that she died
21:31 sometime in the window of 2:30 a.m. to
21:35 6:00 a.m. So there was nothing else on
21:37 her phone or anything about something
21:39 happening or like meeting up with
21:41 someone. Current investigators would not
21:44 go into detail about her phone. They
21:46 just told us that there was nothing in
21:48 there that had any bearing on her
21:50 murder. Now, Carlos actually used to
21:52 have her phone, like after police
21:54 extracted all the data off of it, they
21:55 gave it back to him. But of course, like
21:57 he lost it during a move, which like
21:59 broke my heart cuz I would give anything
22:01 to be able to go through that and like
22:02 try and piece things together. But the
22:05 only thing that Carlos really remembered
22:06 is that Nori called him around midnight
22:09 that night to like maybe meet up, which
22:11 may have been, I think, around the time
22:13 she left Roomba Cafe. But he told her
22:15 that, you know, he was just at a
22:16 friend's party. It was like more of a
22:18 chill hang when she called. And he's
22:19 like, you know, it's not going to be
22:20 worth it for you to come,
22:22 >> which like of course he said,
22:24 >> yeah, he spent like years wondering like
22:27 what would have happened if he told her
22:29 just to come to that party anyways. And
22:31 how long was she at that like lounge
22:33 place before she went to the downtown
22:36 club? Like the timing of it all.
22:37 >> I don't know exactly. I'm sure it is in
22:40 the case files, but we like I said don't
22:41 have those and Detective Patterson
22:43 couldn't remember anything.
22:44 >> Okay. I'm just trying to like gauge
22:45 whether something maybe happened there
22:47 or if she was just like upset by the
22:51 Gustava stuff like the whole she leaves
22:54 crying. As far as we know, she was just
22:56 upset about Gustavo. No one has ever
22:59 come forward with anything else. else.
23:00 I'm saying if someone out there knows
23:02 something else, like now is your time to
23:04 shine. But if it really was just the
23:07 Gustavo stuff, I'm thinking that she was
23:09 probably like drinking all night. She's
23:10 in her feels. Like maybe all of those
23:12 emotions just caught up with her later
23:14 and overwhelmed her,
23:16 >> right? And like everyone else is having
23:17 a good time around her, stuff like that.
23:18 >> Yeah. You just want to go home.
23:20 >> I assume that the police checked
23:22 Gustavo's alibi, right?
23:24 >> Yes. He was one of the first people that
23:26 they brought in for questioning. I mean,
23:28 they have Nory's siblings saying, "Look
23:30 at him." Her friend David was even
23:32 saying, "Look at him." And David didn't
23:34 just know Nory. Like Amanda, he also
23:36 knew Gustavo, too. Because apparently
23:37 one of his family members said that he
23:39 picked up shifts at Gustavo's club. So,
23:41 like, that probably carried some weight.
23:44 Well, not only does Gustavo deny killing
23:47 Nori again and again, he gives Detective
23:50 Patterson an alibi for the night of
23:52 Halloween into the morning after. He
23:54 says he was out with his friends like
23:56 Amanda and that group the whole time.
23:58 Those friends later back that up and
24:01 after he called it a night, Gustavo says
24:02 that he went back to his apartment which
24:04 is above the club and just went to
24:06 sleep.
24:07 >> I mean,
24:08 we don't know when she died though. So,
24:12 >> I guess like is that an alibi?
24:14 >> It's soft, which is why they still
24:16 collect his DNA. And they ask him about
24:20 the third person in this love triangle,
24:23 his wife. Why did she call Nori a couple
24:26 of weeks before her death? Was she
24:29 threatening her? And Gustavo's response
24:32 is surprising. Gustavo said that Nori
24:35 told him about the phone call. So he
24:38 confronted his wife about it, but she
24:40 denied making the call. She denied it
24:43 again when she talked to the reporter
24:45 for that Washington Post article. like
24:47 she herself when she talked to them. But
24:49 Gustavo said that this call scared him
24:52 even more because if his wife didn't
24:55 call Nory, then who did? And why would
24:59 someone pretend to be his wife?
25:01 >> Well, that would open a whole can of
25:03 mystery worms and speculation that
25:06 Detective Patterson thinks aren't
25:08 necessary. He said, quote, "That was
25:12 Gustavo's wife." End quote. So, it seems
25:15 like he thinks she did make that call
25:18 and he took it seriously enough during
25:20 the initial investigation to question
25:22 her, get a verifiable alibi from her,
25:24 and even get her DNA as well. But like,
25:27 why get hers? I thought like male DNA
25:29 was found.
25:29 >> Yes. But I don't You can never be too
25:31 sure.
25:32 >> Yeah. And I mean, like when you think
25:33 about it, like one of the things
25:34 Detective Patterson considered was
25:36 whether a third person could have been
25:38 acting on behalf of Gustavo or his wife.
25:41 I mean, there was someone in particular
25:43 that Patterson even had in mind back
25:45 then. This employee at Gustavo's Club
25:47 who lives in the same building as his
25:49 boss located above the club. This guy
25:52 raised eyebrows because not long after
25:54 Nory's death, Norie's friend David
25:57 alerted police that this employee just
25:58 like up and left the country, went to
26:01 Argentina. The employee said that it was
26:04 for a family funeral, but the timing was
26:06 just like a little too perfect in
26:09 detectives minds. So they actually
26:12 concocted a little sting operation to
26:15 surreptitiously get his DNA. Detective
26:18 Patterson and his partner, they fly down
26:20 to Argentina with two FBI agents. They
26:23 meet the employee under the guise of
26:24 being interested in buying some property
26:26 from him. So they like then make plans
26:28 to have dinner with him. And then during
26:30 dinner when he's away,
26:31 >> this like a whole spy drive,
26:33 >> I'm telling you, they swipe his glass
26:34 and his spoon. They bring the samples
26:36 back to the US and the investigators
26:38 test all three samples. Gustavos, his
26:40 wives, the employees, and then they
26:42 wait, but the DNA results come back one
26:46 by one. No match to Gustavo, no match to
26:50 the wife, and no match to the employee.
26:52 >> Did the employee have an alibi?
26:54 >> Yes. So, as much as anyone can when you
26:57 don't know the time of death, right? And
26:59 surveillance footage showed him still at
27:01 the club for hours after Nory left. And
27:04 investigators also find out, by the way,
27:05 that that funeral in Argentina was
27:07 legit. They didn't just like make that
27:08 up to get out of dodge.
27:10 >> Okay. But I can't come up with a
27:11 scenario where any of these people
27:14 taking like her camera
27:17 >> makes
27:18 I'm obsessed with this camera.
27:20 >> I don't think the wife would have a
27:21 reason. Like the only thing that
27:24 possibly makes sense would be like
27:27 if the wife was like seen in the
27:29 background of a picture that would prove
27:30 that she was like following Norien that
27:33 night.
27:33 >> Yeah. But police know that she wasn't
27:36 out that night based on her alibi. And
27:38 we know that she didn't match the DNA.
27:40 >> Mhm.
27:40 >> So, not her.
27:42 >> I guess the employee wouldn't want to be
27:44 seen in a picture if it was like at one
27:46 of the last two places she went to. Like
27:48 him being in pictures from like the
27:50 Roomba cafe doesn't mean anything cuz he
27:51 works there. We know he's there,
27:53 >> right?
27:53 >> If it was Gustavo,
27:56 I think he has the most to hide if there
27:58 were pictures of him and Nori together
28:01 on the camera. But that would be like if
28:03 his wife didn't know about the affair
28:06 and we have detective Patterson saying
28:07 that like he absolutely believes that
28:09 she did,
28:10 >> right? So,
28:11 >> so the question becomes like who else
28:14 would have been on that camera from that
28:15 night?
28:16 >> I think the other people who were with
28:18 her that night probably and
28:20 investigators check those people out. I
28:22 mean, they look at her dance partner. He
28:24 was the last one with her, right? He's
28:25 the one that puts her in the cab to go
28:26 home. But there's no motive there.
28:28 there. I mean, he was only with her for
28:30 a few minutes, and icing on the cake,
28:32 his DNA wasn't a match either. Truth be
28:35 told, Patterson said they never really
28:37 even suspected him. They really just
28:39 tested his DNA to make sure that they
28:42 were leaving no stone unturned,
28:44 >> crossing tees, dotting eyes. But the
28:46 real person who drew a lot of suspicion
28:49 from police was somebody that Nori had
28:52 known for years. Somebody she trusted.
28:55 The very man who offered up Gustavo's
28:58 name as a suspect. The one who then
29:00 pointed police in the direction of
29:02 Gustavo's employee. The same man who
29:05 somehow showed up to the crime scene, by
29:08 the way, the same day that Nory was
29:11 found without being called. And that's
29:15 David.
29:17 Okay, let's take a break. You guys,
29:19 between my work with our reporters and
29:20 production team and, you know, recording
29:22 and running a company and being a wife
29:23 and mother, I get approximately 30
29:26 minutes of me time a day.
29:28 Which means if I want to get a workout
29:30 in, it needs to happen whenever and
29:32 wherever I have time. And sometimes
29:34 that's our spare studio. I don't have a
29:36 gym. I don't have a team pushing me.
29:38 What I have is a little bit of space to
29:40 move, some weights, and the ladder app.
29:43 With the ladder app, it's like I have a
29:45 personal trainer right in my headphones
29:47 pushing me not just through every set,
29:50 but week after week as my training plan
29:52 builds off the work that I've done
29:54 through structured training blocks. And
29:56 it's not just the elite level coaching
29:58 that you get. The Ladder app offers
30:01 community and built-in nutrition
30:03 tracking. And you get it all for less
30:05 than $1 per day. Remove the guesswork
30:08 with Ladder and get a real coach in your

30:32 David and Nory knew each other well. One
30:35 of David's family members told us that
30:37 he and Nory went way back, like all the
30:39 way back to high school. They were part
30:42 of a group that stayed in touch as they
30:44 grew up. And David would still go out
30:45 salsa dancing with Nory and their
30:47 friends from time to time. And from
30:49 Detective Patterson's perspective,
30:51 David's basically been a part of this
30:54 investigation from the beginning. Though
30:57 to begin with, he was just a witness.
31:00 one who was conveniently in Nor's
31:03 building the night that her body was
31:06 found, like as police were processing
31:08 the scene. So, let me lay it out for
31:11 you. Nor's sister Liz told us that after
31:14 the 911 call, police took over the
31:16 apartment and asked Carlos and Liz to
31:18 move into the hallway. And when Liz
31:20 walked out, David was there waiting in
31:24 the crowd that had gathered around the
31:25 door to see what was going on. Now, she
31:28 can't tell us exactly how many minutes
31:30 had passed since police got there or
31:32 what time she saw David. Like,
31:33 everything was just happening quickly,
31:35 >> but the way she remembers it, they found
31:37 Nory and then in her words, poof, David
31:40 was suddenly right outside the
31:41 apartment. Like, to her, it felt quick.
31:43 Like too quick.
31:45 >> I mean, did someone call him?
31:46 >> Not Carlos or Liz. I mean, and there
31:49 could be, listen, an innocent
31:51 explanation for this.
31:52 >> Okay. Well, what's his explanation?
31:54 Well, we've tried multiple ways,
31:56 multiple times to get in touch with him.
31:58 We haven't been able to make contact.
32:01 Detective Patterson remembers that his
32:03 explanation was like weird and he
32:06 remembers asking David about it, but he
32:08 doesn't remember
32:09 >> like what it actually was.
32:10 >> Yes. Unfortunately, now what I will say
32:13 is that Carlos said David was calling
32:15 Nory at the same time. Like Carlos had
32:17 her phone because of, you know, David
32:20 hadn't heard from her. So maybe he got
32:21 worried and went to go look for her just
32:23 like Carlos did. But another friend of
32:26 Norris had this weird interaction with
32:28 David, too. She was at work when she
32:31 found out that Nory was murdered. So
32:33 friends picked her up and drove her to
32:35 Nory's mom's house. On the way, she
32:37 called the house to like, you know, let
32:39 them know she was coming, make sure it
32:40 was okay. And it was David that
32:42 answered. He was there. And off the bat,
32:44 David started like launching into this
32:47 really detailed explanation of where he
32:50 was the night Nory died and why he
32:52 wasn't with her. Like he got sick, he
32:54 had a cold or something. So he went
32:55 home, took some meds, and then he fell
32:56 asleep and then he just overslept. And
32:58 Nory's friend was sitting there thinking
33:00 like, why are you telling me? Like why
33:02 aren't we talking about Nory?
33:04 >> But she just let him go on and on. And
33:06 she told us as soon as she hung up, she
33:08 turned to the people in the car and said
33:11 that was the weirdest conversation. But
33:14 back to Nory's apartment that day, like
33:16 when David showed up to the scene, he
33:19 told police that he was with Nori that
33:22 night. So obviously he went down to the
33:23 police station with Carlos and Liz to
33:26 give a statement. But Liz said that he
33:28 just started like throwing out theories
33:30 and names. I mean, at that point though,
33:32 police were like taking every lead he'll
33:34 throw their way, jotting names down left
33:36 and right. But as Detective Patterson
33:38 tries to nail down David's relationship
33:40 with Nory and his movements that
33:42 Halloween weekend, things to him start
33:46 feeling kind of shifty. According to
33:48 Detective Patterson, David told him that
33:50 he was out that night with Nory at
33:52 Gustavo's club and he got so drunk that
33:55 somebody from the club drove him home
33:57 because he couldn't drive himself. And
34:00 wait, didn't he tell the friend that he
34:02 had a cold and went home and took
34:03 medicine?
34:04 >> Yes, that is what that friend remembers,
34:08 but it was a highly emotional time. Who
34:10 knows? Anyways, his place is like 40
34:14 minutes away in Maryland, meaning that
34:17 when someone drove him home, he had to
34:18 leave his car in DC. So, David said that
34:21 he came back to DC at some point the
34:24 next day to pick it up. And Detective
34:26 Patterson starts asking him, okay, like
34:28 where exactly did you leave your car?
34:30 How did you get back into the city? When
34:32 did you get back into the city? How long
34:33 were you here?
34:34 >> And and that's like the important part,
34:36 right? Like was he in DC, I don't know,
34:39 say between like 2:30 and 6 a.m.
34:42 >> Want to pull your hair out? So all these
34:45 years later, Detective Patterson can't
34:47 remember exactly what David said, and we
34:51 could not get an answer from current
34:53 investigators on this or from David
34:56 himself. But Detective Patterson told us
34:59 that he remembers David's answers just
35:03 weren't adding up. I mean, he said,
35:05 quote, "The math ain't mathing."
35:07 And then Detective Patterson learned
35:10 just how much Nory trusted David and how
35:13 much access he had to her apartment.
35:17 Because remember, one thing that he took
35:19 note of when he was first on the scene
35:21 was the fact that there was no forced
35:22 entry and the door to Nor's apartment
35:25 was locked when Carlos tried to check on
35:28 her. He had to get the security guard to
35:30 open it. Now, there are some alternate
35:33 possibilities around all of this that
35:34 I'm going to get into later, but based
35:36 on everything Detective Patterson saw at
35:38 the scene, he always thought that this
35:41 crime was personal, somebody Nory knew,
35:45 maybe somebody who even had a key to her
35:48 place. And Nory's brother Carlos tells
35:50 him David had one for a very interesting
35:55 reason.
35:56 So, at this time back in 2009, David was
36:00 married to a woman, but he was also
36:03 seeing men. Detective Patterson says
36:06 there was one man in particular that
36:08 they heard about who I'll call Eric for
36:10 privacy reasons. And apparently, Nory
36:13 let David use her apartment at this like
36:16 private place for them to meet up. Now,
36:18 when David was asked by Detective
36:20 Patterson if he had a key, he completely
36:23 denied it. and they were never able to
36:25 recover one from him. So, he very well
36:27 could be telling the truth. And really,
36:30 the key thing might not even be that big
36:33 of a deal because we were told Nory
36:36 actually left her door unlocked all the
36:38 time. Like I told you, her building had
36:40 like all this like security, security
36:42 guard, all these like door the keep up
36:43 whatever and it made her feel like she
36:45 was like
36:46 >> Yeah. living in a super secure place and
36:48 like she didn't necessarily always need
36:49 that extra layer. Carlos also told us
36:52 that she may have started even leaving
36:54 her door unlocked specifically for
36:57 David.
36:57 >> I guess I don't get what his motive
36:59 would be though cuz it sounds like Nory
37:01 was helping him out.
37:03 >> Well, that could come back to Nory's
37:06 camera. So, a source told us that
37:10 detectives learned that before Nory
37:13 died, she downloaded a batch of recent
37:17 photos from her digital camera onto a
37:19 computer at the restaurant because her
37:22 own computer wasn't working. And in
37:25 those files were pictures of David and
37:28 Eric together at a club, like dancing
37:31 and kissing. Oh, yeah. Now, I think it's
37:34 important to note that our reporter,
37:36 Malica, actually tracked down David's
37:38 wife, ex-wife now, and she told us that
37:41 she knew David was having affairs. She
37:43 and David were already sleeping in
37:45 separate rooms. And after Nory died,
37:47 they got divorced. So, I don't think her
37:51 finding out would have been motive for
37:53 anything, but that doesn't mean that he
37:55 was ready for the world to know.
37:58 >> And what was Eric's situation? So, from
38:00 what we could tell from like social
38:02 media, Eric was a couple of years out of
38:04 college working as a waiter back in
38:05 2009, not at Roomba Cafe as far as we
38:08 know. And I don't know if he was fully
38:10 out either, but he was like friendly
38:12 with Nory and her friends through David.
38:14 It seems like he was out with them at
38:17 least. And we actually reached out to
38:18 Eric during our reporting. And when we
38:20 asked if he would speak with us about
38:22 Nori, even just about like knowing her,
38:24 he said something like, "No, I mean like
38:27 rest in peace, Nori, but no." Listen,
38:29 here's the problem I have with all of
38:33 that, like motive or whatever. Nory
38:36 already downloaded those pictures of
38:38 David and Eric onto a computer. So,
38:40 like, if that was something you were
38:42 hiding, either one of them, taking the
38:44 camera,
38:45 >> you don't need the camera. You need the
38:46 computer at the restaurant. Yeah, but
38:48 maybe whoever did this didn't know that,
38:51 right? Like her computer isn't working.
38:53 They might think that like they might
38:54 not think about the computer at work.
38:56 They could think that everything is
38:57 still on the camera.
38:58 >> Sure, but why wait till that night? Like
39:01 if those pictures were so damning to
39:03 someone like to me, you get the c you
39:05 get the camera like the night that those
39:07 pictures were taken. That wasn't
39:09 Halloween.
39:10 I think that if the camera is relevant,
39:13 the pictures have to correspond to that
39:16 night.
39:17 >> And was Eric with David that night?
39:19 >> It doesn't seem like it. I mean,
39:20 remember, David leaves on his own when
39:22 he gets drunk, as far as we know, which
39:23 like doesn't mean that they couldn't
39:24 have met up later, but
39:26 >> yeah, either way, they collect both
39:29 men's DNA, and neither of them was a
39:32 match for the DNA that they have on
39:34 Nory. But even with that, there is
39:38 something that Detective Patterson just
39:40 can't shake about David. He doesn't
39:43 think that he was the one who killed
39:45 Nory, but in his personal opinion, he
39:47 has always believed that David may have
39:50 had some involvement or at least knew
39:53 more than he admitted.
39:55 >> David only. I mean, what about Eric?
39:57 >> I mean, Detective Patterson didn't say
39:59 much about Eric. Like I mean it seems
40:00 like most of his focus has been David.
40:02 But he is also clear that until they
40:04 know what happened to Nory. Like
40:06 nobody's completely off the table, but I
40:08 said it doesn't seem like he's really
40:09 like zeroing in on him at all.
40:12 >> Though I will say Eric may not have been
40:16 the only man that David was seeing. I
40:19 mean for almost the whole time we were
40:21 reporting on this story, we didn't hear
40:22 other names just like oh you know David
40:24 saw men in general. But we just learned
40:28 something from a friend of Norris that I
40:31 find very interesting. So this friend
40:35 told us that just a few weeks before
40:37 Norie's murder, she had stopped by Nor's
40:39 restaurant while David was there. And
40:41 Norie started telling her about a
40:43 different man that David was seeing who
40:46 was apparently a diplomat.
40:48 Norie's friend couldn't remember this
40:51 guy's name or even where he was from.
40:54 But Nory told this friend that she and
40:56 David went to a hotel where this
40:58 diplomat was staying. And Nory got into
41:00 an argument with this diplomat. She
41:03 basically called this guy out over the
41:05 way that he was acting toward David,
41:07 telling him like, "You're not a man.
41:08 What kind of man acts like this?" And
41:10 apparently she wasn't backing down. And
41:13 Nory's friend remembers like in that
41:15 moment being a little scared for Nori.
41:17 Like you know, if this guy really was a
41:19 diplomat, like he's probably powerful.
41:21 and Nory was just going off on him. Now,
41:24 she didn't hear anything more about this
41:26 guy, so maybe this is totally random,
41:29 but I can't verify an alibi or confirm
41:32 if his DNA was tested because this came
41:34 up so late in our reporting. We had
41:35 already done our interview with
41:36 Detective Patterson. We tried reaching
41:38 back out to him, but he has not gotten
41:40 back to us about our questions
41:41 surrounding this diplomat. The only
41:44 person who would even confirm that
41:47 police heard about a diplomat was Nory's
41:50 brother, Carlos. And he was interesting
41:52 to work with. Like, I mean, he's great.
41:54 He wants Nory's case solved more than
41:56 anyone. And yes, they they checked his
41:58 DNA and alibi, like everything. He has
42:00 never been a suspect. But, you know,
42:02 he's really cognizant of not hurting the
42:05 investigation. So, like if we learned
42:07 something from somewhere else, someone
42:09 else, he would confirm it. But he wasn't
42:11 necessarily like serving up any
42:13 information on his own.
42:14 >> Yes. And so that's like how it was with
42:16 this diplomat. So once we asked him
42:18 about this, he told us that he remembers
42:20 the diplomat being from Mexico. And he
42:24 remembers investigators tracking this
42:26 guy down and talking to him, but he
42:28 doesn't think anything came of it.
42:31 Though I don't know what that means or
42:33 how far they got with the guy. And I
42:35 don't know if that guy, whoever he is,
42:38 was even in DC on Halloween night 2009,
42:42 but I would love to ask.
42:44 >> Well, and I was wondering like, did
42:46 David and this diplomat ever use Nory's
42:49 apartment?
42:49 >> Me, too. I assume police have asked
42:53 David. I mean, Detective Patterson was
42:55 thorough, but we can't be sure until he
42:57 gets back to us.
42:58 >> I mean, if Patterson's theory is that
43:00 David knows more, someone like a
43:03 diplomat would make sense. someone he
43:06 might be afraid of. Or maybe there's
43:07 somebody else that he was involved with
43:10 that is yet to be identified. Or maybe
43:13 David really isn't involved at all. Even
43:16 though we didn't make contact with him,
43:18 we did speak to members of David's
43:19 family who remember him being devastated
43:21 by Nory's death. I mean, one family
43:23 member remembers him crying and saying
43:26 like she was my friend. Another
43:28 remembers how shocked he seemed, saying,
43:30 "I just saw her. I cannot believe this
43:32 happened." and they don't believe that
43:34 David was involved in Norie's murder and
43:37 he has never been charged with anything
43:39 in relation to it. Now, key or no key,
43:42 we did learn that Nori was known to
43:44 leave her apartment door unlocked. Like
43:46 the I told you the building had a
43:48 security guy at the front. It had
43:49 multiple cameras. You had to like use a
43:51 pass thing in order to get in. She felt
43:53 safe.
43:53 >> Yeah. She like it was there were so many
43:55 layers of security. Sometimes she didn't
43:56 feel like she needed that extra one.
43:58 >> Anyone could have come in.
44:00 >> Yes. But I'm stuck on how they would
44:02 have locked up behind them when they
44:04 left because you would need a key for
44:06 that.
44:06 >> I was going to come back to this. So, I
44:08 didn't want to get sidetracked. Here's
44:10 the thing. So, no one could or would
44:12 tell us definitively if Nory's keys were
44:14 all accounted for. Police say the only
44:17 thing missing was that camera of hers.
44:18 So, I assume that no keys were missing,
44:22 but we don't know for sure.
44:23 >> Especially if she had spares, right,
44:25 that she was like giving
44:26 >> she had made like there's no account of,
44:28 right? But more importantly, we know for
44:30 certain that someone else was in Nor's
44:34 apartment after she died, and they may
44:37 have locked her apartment door. When
44:40 police processed her apartment, they
44:42 found a card for an exterminator, and
44:44 they found out that the building had
44:45 scheduled like a maintenance thing for
44:47 the units on Monday, the same Monday
44:49 that Nory was found. So, an exterminator
44:52 had a key to let himself in. He sprayed.
44:55 He left. And when he left, it's very
44:59 likely he might have been the one who
45:01 actually locked the door like behind
45:03 him.
45:03 >> Wait, so he was in her apartment with
45:06 her dead body,
45:07 >> which I know sounds bananas. I like
45:09 spiraled on this. Detective Patterson
45:11 interviewed this guy. He said the guy
45:12 never actually went into the bedroom. He
45:14 had no idea that she was in there. And
45:18 this exterminator unfortunately doesn't
45:20 remember if the door already was locked
45:22 or unlocked when he went into
45:23 >> one of those things that you don't think
45:25 about remembering when it's happening.
45:26 >> So like I don't know is the fact that
45:28 there's no force entry doesn't mean
45:30 anything at all. I have no idea.
45:32 >> And they checked this guy's DNA, right?
45:34 Like the exterminator.
45:35 >> Yep. He's not a match.
45:36 >> So if someone didn't need to be let in
45:38 or have a key, that could open up the
45:41 suspect pool really, really wide. Maybe
45:46 it isn't somebody who knew her. Maybe
45:49 that's why this case has been so hard to
45:52 solve. Detective Patterson points to
45:55 things like the fact that Nory was
45:57 covered with the comforter after she was
45:59 killed. Like he says that's behavior you
46:01 often see when somebody cares for the
46:03 victim.
46:03 >> Right. But it can also be something that
46:05 a killer does if they're like ashamed of
46:08 what they did. Like
46:08 >> like if the murder wasn't the plan,
46:10 right?
46:11 >> Yeah. like you know maybe they had gone
46:12 in with the goal of some kind of like
46:15 sexual assault and things like got out
46:17 of
46:17 >> escalated like out of hand right
46:19 >> now interestingly Carlos ran into a
46:22 friend sometime a few months ago
46:24 somebody who's known both his family and
46:26 David for years and that friend told
46:28 Carlos that they ran into David recently
46:31 and David started talking about Nori he
46:34 allegedly described her death as a
46:36 sexual situation that went wrong that
46:39 night. Now, from what I can tell, we are
46:44 actually the first to report
46:45 confirmation of sexual assault. That was
46:49 never confirmed by police before. So,
46:52 back when this was said, it wasn't
46:54 public knowledge. Carlos obviously told
46:56 Detective Patterson it piqued his
46:58 interest because he's like, you know, in
47:00 all the times that I've talked to David,
47:02 David has never described Nory's death
47:04 as a sexual situation gone wrong.
47:06 any of the many theories that he
47:08 suggested to police.
47:10 >> Now, by this point, Patterson is
47:12 retired, so he passed the information on
47:14 to the current investigator,
47:16 >> but it might mean nothing. I mean, we
47:18 are hearing this secondhand. The friend
47:20 who supposedly heard this from David
47:22 wouldn't talk to us. And even if it was
47:24 said, it wasn't a secret that she was
47:27 found only in her underwear, in her bed.
47:29 Like maybe as more was reported or
47:32 shared with like their friend group or
47:34 family, it could have been an inference
47:37 that David made since it doesn't look
47:39 like she was robbed. Like it's not a
47:40 wild conclusion to jump to,
47:43 >> right? But like not robbed, sure, but we
47:45 do think something was taken.
47:47 >> We think something was taken. We know
47:51 Nori had her camera out that night, but
47:54 the truth is we can't see it in the
47:57 surveillance video when she comes home.
48:00 She's got like a purse or a bag or
48:01 something. So, like it might be in there
48:03 or maybe it got stolen. Like one of the
48:05 things I've I've been wondering, they
48:07 spend so much time or at least Detective
48:08 Patterson did talking about this camera
48:10 or this thing missing. I've I've often
48:12 wondered if it got like left in the cab.
48:15 >> Oh, with her phone.
48:15 >> With her phone, right? Phones are a
48:17 little easier to trace. like you you
48:19 want to give that back to the owner.
48:20 Cameras like poof, gone, easy. Finders,
48:23 keepers, like
48:23 >> they're also like easier to like pawn or
48:25 sell or get rid of or something.
48:27 >> My cyershot got stolen when I was in
48:29 high school. I don't want to talk. Still
48:31 a tender subject.
48:34 And listen, I keep coming back to like
48:35 if this was about the camera or the
48:38 pictures on the camera,
48:40 >> the thing I can't figure out is why kill
48:42 her? Why sexually assault her? Well,
48:45 that's if the camera had something on
48:47 it. Like we've been talking about like
48:48 evidence of an affair. But like one of
48:50 the pictures just showed someone she was
48:52 with that night who came back for her.
48:54 Like maybe it showed their costume and
48:57 would prove that they were both in her
48:59 lobby and
49:00 >> out like with her when she was out at
49:02 all these places.
49:03 >> I've thought I've thought about that. I
49:04 mean that's totally possible. Like
49:06 without the camera we have no idea
49:07 what's on it. I've also, I'll tell you,
49:09 thought like thrown around like a darker
49:12 theory like what if somebody used the
49:14 camera to take pictures of Nory after
49:17 they killed her or even just like took
49:18 it as a souvenir, a
49:20 >> trophy.
49:20 >> Yeah. If it was taken, we don't really
49:22 actually know the reason why.
49:25 >> The thing I keep coming back to and that
49:27 I just can't let go for some reason.
49:28 It's like her complex was so big. I keep
49:33 wondering how hard they looked at every
49:35 single person inside of it. Maybe the
49:39 killer was never caught on surveillance
49:40 cameras coming or going because they
49:42 were already there.
49:44 >> They could have known her habits. They
49:45 could have known that she was somebody
49:46 who didn't always lock her door. They
49:49 would know that there's no cameras in
49:50 the hallways. Now, I know Detective
49:52 Patterson explored that possibility,
49:55 too. He says that investigators went
49:57 door todo on Nory's floor talking to her
50:00 nextdoor neighbor and several other
50:02 people who like lived down the hall and
50:04 police did collect DNA from some people
50:06 connected to the building like even the
50:08 security guard who let Carlos and Liz
50:10 into Nor's unit.
50:12 >> I don't know exactly who else though or
50:14 an exact number of people even hearing
50:18 like oh we went door to door on her
50:19 floor that's great. What I was told is
50:21 there's more than,00 units.
50:23 >> Yeah. I was like, in perspective, the
50:25 town I grew up in is 1,600 people.
50:28 >> Yeah, that's all of Wakarusa.
50:29 >> That's all of Wakarusa to be tested
50:31 >> or talked to or contacted. And that's
50:34 kind of a huge number for a small place.
50:36 >> And what I'll say is like it's not like
50:38 they just looked right then because
50:40 Carlos remembers at least one resident
50:42 being tested years later after he died
50:45 by suicide. I think they wondered, you
50:47 know, could there have been a
50:48 connection? Seems like no. But overall,
50:50 Patterson remembers personally
50:52 collecting DNA from around 10 people and
50:55 later reporting says more than 20 people
50:57 were eventually tested. Still, again,
51:00 very big building. And I wonder if there
51:04 was someone in there who might have been
51:06 hiding in plain sight.
51:09 That DNA will be a major key to solving
51:12 this case. I really believe it's only a
51:15 matter of time. I mean, even though they
51:16 used the sample to get a profile good
51:18 enough for COD, there was some left that
51:21 could be used for IGG one day. Now, back
51:24 before Patterson retired in 2017, he
51:27 sent off the sample they had to Parabon
51:29 NanoLabs for analysis.
51:30 >> That was even before IGG was really a
51:32 thing.
51:33 >> They were doing still phenotyping, stuff
51:35 like that back then, but like right on
51:37 the cusp. And at the time, they were
51:39 told to wait. Like anything they were
51:40 going to do was going to use up the
51:41 entire sample. It's like all they had
51:44 left. the technology needed to get a
51:46 little bit better. Now, remember, he
51:48 retired, so he doesn't know what has
51:50 happened with that sample since he left.
51:53 I mean, it's been almost 10 years. I
51:55 mean, surely there's there's got to be
51:57 something they can do now.
51:59 >> I hope. I mean, for the sake of
52:00 everybody who has been pushing to get
52:03 this thing solved. None more than Nory's
52:05 family who have spent the last 16 years
52:08 trying to hold on hope that her case is
52:10 going to get solved. Carlos threw
52:13 himself into finding answers. I mean, he
52:15 chased leads. He called investigators.
52:17 And for a long time, he tried to solve
52:19 the case himself. And eventually, he
52:21 went to therapy. He started helping
52:23 other people work through their trauma,
52:25 too. And he says that today, the pain of
52:27 losing his sister, Nory, doesn't control
52:30 him the way that it once did. His Nori
52:33 sister Liz actually took a little bit of
52:34 a different path, though. She ended up
52:36 studying criminal justice and forensics.
52:38 like she had said she always had been
52:40 interested in that world, but Nory's
52:42 case became what she calls this
52:44 inspirational factor in the path that
52:46 she took.
52:47 >> And even though she's found ways to move
52:49 forward, she says that learning how to
52:50 live without Nori isn't the same thing
52:52 as accepting that nobody's ever been
52:54 held accountable for killing her.
52:56 >> So DNA might be the thing that solves
52:58 this case, but both Liz and Carlos
53:01 believe that somebody in Nor's world
53:03 knows more about what happened than
53:05 they've said. So the answers might not
53:08 hinge on just the evidence alone. They
53:11 might be with somebody out there
53:13 listening right now. So for our
53:16 listeners who were in the DC area back
53:18 in 2009, listen up. And if it's not you,
53:21 pass this episode on to somebody who
53:23 was. If you were at one of the DC clubs
53:26 Nory went to on Halloween night in 2009,
53:29 we want to hear from you. Even if you
53:31 don't think you have anything super
53:32 important, maybe you have pictures or
53:34 videos from that night. Who knows? The
53:38 names of the places are Roomba Cafe,
53:40 Russia House, and Bravo Bravo. And if
53:44 you lived or worked at Norri's building,
53:46 the Woodner, we want to hear from you,
53:48 too. Especially if you remember anything
53:50 from October 31st or November 1st, 2009.
53:54 But honestly, anytime around then, too.
53:56 Like, was anything going on in the
53:58 building? Any weird instances? anyone
54:00 who stood out. And I know I had to
54:03 change a lot of the names in this
54:05 episode for privacy, but if you
54:07 recognize the people that I've talked
54:08 about and you have had any interaction
54:10 with them, or if you've heard anything,
54:13 come forward. What you know or heard
54:16 might be something small. Maybe it
54:18 sounded like gossip or didn't feel
54:19 important enough to report. Maybe you
54:21 assume the detectives already knew, but
54:23 one tiny detail could be the break
54:25 investigators have been waiting for. You
54:28 can reach them by calling MPD at
54:30 202-72799
54:35 or you can reach us as always by
54:37 emailing tips@auudiochuck.com.
54:42 Crime Junkie is an Audiochuck
54:44 production.
54:46 I think Chuck would approve.
